Chicago, Ill. – Taxpayers are increasingly confused about the ads they hear on the airwaves regarding the IRS program called the “Fresh Start Initiative.”

One of those ads might sound something like this:
“If you owe the IRS $10,000 or more, you could be eligible for the Fresh Start Initiative and get massive savings on your tax debts!”
Just about any taxpayer in a situation where they owe the IRS tens of thousands of dollars, will think this sounds like the lifeline they’ve been hoping for.
The idea of getting rid of all the stress of having a tax debt hovering over them, and being able to get on with his or her life…
Except, the problem is there’s a bit of a lie hidden in those ads. Because the program they’re describing in the ad isn’t a fresh start at all.
So what is the IRS Fresh Start Initiative? Here’s how the IRS describes the program:
The IRS Fresh Start program makes it easier for taxpayers to pay back taxes and avoid tax liens. Even small business taxpayers may benefit from Fresh Start.
As you can see, there’s no mention of any actual reduction of a taxpayer’s debt to the IRS. In fact, all this program is offering is a structured payment schedule that will be applied using automatic withdrawals from a checking or savings account.
And it gets even worse, because there is crucial information that you will never hear in those “Fresh Start” ads. And it’s the type of information anyone would want to know before going into discussions with a tax firm.
Here’s what the IRS does with your tax situation during a Fresh Start repayment plan:
However, there is another method for reducing a tax debt if certain conditions apply.
If you owe the IRS $10,000 or more and wish to have your tax debt reduced, there is a method called an “Offer in Compromise”.
What this means is the IRS and the taxpayer reach an agreement to pay a portion of their tax debt that is less than the full amount. You pay the settlement amount and then walk away.
As long as you don’t’ fall behind on your taxes for the next 5 years, you’re good. Keep all your refunds. No monthly payments.
For instance, suppose you owe the IRS $50,000. You could potentially reach a settlement to pay only $5,000.
Here are the conditions that need to be met, per the IRS, to receive an Offer in Compromise:
1. You cannot afford to pay what is owed to the IRS on the tax debt. More specifically, the IRS doesn’t believe it could collect the tax debt now or in the foreseeable future. And, collecting that tax debt in full would cause an economic hardship or be considered “unfair.” You could be eligible for an Offer In Compromise.
2. You must have all your tax returns filed, and you will need to make an initial payment on your existing tax debt.
3. You must have an application for an Offer In Compromise filed with the IRS.
If you meet the criteria above, then it may be possible for you to get a significant reduction in your tax debt.
As you probably heard in the Fresh Start ads mentioned earlier, a “free consultation” is typically offered to you.
What normally happens is you get on the phone with a sales representative who collects your information, but that’s where the “free” part stops.
Most of the time, you’ll be asked to pay $500 and sometimes even a bigger upfront fee of $8,000 or more just to get any communications going with the IRS.
